US Supreme Court leaves Trump‑Era China tariffs in place

On June 15, the United States Supreme Court declined to hear a challenge by HMTX Industries and other importers to tariffs imposed on Chinese goods during former President Donald Trump’s first term. The tariffs, originally set under Section 301 of the Trade Act of 1974 and later modified under Section 307, remain in effect after the Court’s refusal to grant review, following a prior appellate ruling that upheld them.

Industry observers note that even if manufacturers succeed in obtaining refunds for the tariffs they paid, retailers are unlikely to receive direct refunds. Manufacturers have absorbed much of the tariff cost and incurred legal expenses, and most do not plan to pass on any recovered amounts. Some may offer discounts to retailers, but a broad refund to downstream sellers is not expected.
