Venâncio Mondlane faces Supreme Court trial as immunity is lifted

Mozambique’s Council of State has suspended the immunity of Venâncio Mondlane, a member of the body and former presidential candidate, to allow the Supreme Court to proceed with criminal charges against him.

Mondlane faces five charges related to the post-electoral protests of late 2024, including incitement to terrorism, incitement to disobedience, and public apology for a crime. He has been notified that the trial is expected to occur within the next two to three months.

The decision, documented in Deliberation No. 1/CE/PR/2026, has drawn significant criticism from political analysts and human rights advocates. Adriano Nuvunga of the Centre for Democracy and Human Rights characterized the move as the ‘judicialization of politics’ and an attempt at political silencing. Similarly, the National Alliance for a Free and Autonomous Mozambique (Anamola) has called for a transparent and impartial trial, calling the case a ‘litmus test’ for the country’s justice system.

Mondlane has challenged the legality of the decision, declaring it ‘null and void’ on the grounds that the Council of State lacks the competence to suspend its own members' immunity.
