Vietnam drafts real‑estate law to tackle HH Linh Đàm red‑title problem

Experts highlighted the case of the HH Linh Đàm apartment complex in Hanoi, where many owners have not received red‑title deeds because the developer violated planning rules. Economist Vũ Đình Ánh warned that current law offers no clear mechanism to protect buyers, saying, “Nếu các chủ đầu tư tuân thủ theo quy định của pháp luật thì sẽ không xảy ra chuyện gì, nhưng thực tế họ đâu có tuân thủ.”  He also called proposals to return homes and money “nghe không ổn một tí nào.”

The draft Law on Real‑Estate Business, being revised after a public hearing on 15 July, will be submitted to the National Assembly for its first reading in August and a second reading in October 2026. The bill seeks to define developers’ obligations, buyers’ rights, and introduce a model contract. It also aims to curb risky financing practices, such as developers mortgaging projects before completion, which can create multiple mortgages on a single property and threaten credit stability.
