Vietnam imposes heavy penalties for early rental of social housing

Vietnam's 2023 Housing Law prohibits owners of social‑housing units from selling or sub‑letting the property within five years of full payment, except in limited cases such as sale back to the developer or qualified buyers.

The Ministry of Construction clarified that violations are punishable by administrative fines ranging from 100 million to 120 million VND and may lead to the revocation of the social‑housing unit. The penalties are stipulated in Decree 16/2022/ND‑CP (article 64) and Decree 100/2024/ND‑CP, which also assign local authorities the duty to monitor compliance.

Potential owners are advised to review the relevant legal provisions before attempting to rent out or transfer their units to avoid the severe financial and ownership consequences.
