Vietnam Land Law debate focuses on mandatory notarization

During discussions regarding the 2024 Land Law amendments in the National Assembly, lawmakers and officials debated whether mandatory notarization should be removed from real estate transactions.

Nguyen Thi Hong Hanh, Director of the Ho Chi Minh City Department of Justice, expressed concerns that eliminating mandatory notarization could create significant legal risks. She argued that while digital databases are improving, they cannot replace the role of notarization in verifying the voluntary intent of parties in transactions involving life-long assets.

In response, Minister of Natural Resources and Environment Trinh Viet Hung suggested that notarization is primarily an administrative procedure and does not strictly need to be codified within the Land Law itself. He clarified that removing it from the primary law does not mean citizens lose their legal rights or obligations, as these protections can be maintained through draft decrees. The Minister noted that the government aims to reduce administrative burdens in line with national policy, while ensuring harmony between the Land Law and the Law on Notarization.
