Vietnam Ministry clarifies land compensation for mixed-use plots

The Ministry of Natural Resources and Environment has provided guidance regarding land compensation for mixed-use land where the specific location of residential land is not clearly indicated on the land use certificate.

In response to an inquiry about whether compensation would prioritize agricultural or residential land classification, the Ministry stated that the procedures for land recovery, compensation, support, and resettlement must follow the 2024 Land Law and subsequent government decrees.

During the investigation, survey, and measurement process for compensation planning, the relevant organizations are responsible for coordinating with local authorities and property owners to determine the specific type of land and assets attached to it. Because the specific case lacked supporting documentation, the Ministry advised the individual to consult local land management agencies for a resolution based on their specific jurisdiction.
