Vietnam proposes amendments to 2024 Land Law

The Ministry of Natural Resources and Environment has completed a summary report on the implementation of the 2024 Land Law, proposing several key amendments to address practical obstacles and ensure legal consistency.

One major proposal involves reforming land use planning and planning methods. This includes shifting from mere land use quotas to unified territorial space planning that aligns with provincial, urban, and rural planning. The goal is to resolve issues of overlapping land use, resource waste, and complex approval processes. Additionally, the proposal seeks to tighten authority over planning adjustments to prevent arbitrary changes and to better manage underground and sea reclamation spaces.

Another significant proposal in the draft amendment concerns the issuance of land use certificates (red books). The state may consider granting certificates to land users who committed procedural violations prior to August 1, 2024, provided the land has been used stably, is not under dispute, complies with planning, and does not impact national security or the environment. Users must also fulfill or commit to fulfilling their financial obligations to the state. This policy aims to address historical legal issues while maintaining strict regulatory standards.
