Vietnam proposes amendments to Land Law regarding compensation and management
The Ministry of Natural Resources and Environment is finalizing a draft of the amended Land Law to be submitted to the National Assembly for consideration during its second session, expected in October 2026. The draft focuses on seven major policy groups, including land-use planning, land allocation and leasing mechanisms, and administrative reforms through digital transformation.
A key component of the amendment involves new regulations regarding compensation, support, and resettlement for citizens when the State recovers land. Unlike the 2024 Land Law, the new draft will only provide framework principles, allowing the Government and local authorities to establish more flexible, practical regulations for fluctuating real-world conditions.
Additionally, the Ministry has proposed two options for the decentralization of land management authority. Option 1, which the Ministry recommends, would codify existing practices by allowing provincial People's Committees to decide on land recovery, compensation, and leasing, with the ability to further delegate authority. Option 2 would explicitly define authority within the law, assigning decisions for organizations to provincial levels and decisions for individuals or communities to commune-level People's Committees.
