Vietnam Supreme People's Court issues new land law penalty regulations

The Council of Justices of the Supreme People's Court has issued Resolution No. 04/2026/NQ-HĐTP, which is set to take effect on October 15, 2026. This regulation introduces a framework for reducing penalties for individuals or organizations that violate land laws under specific mechanisms and policies.

Under the new resolution, the severity of the penalty reduction is directly tied to the extent of economic damage remediation completed by the time of trial. The court will evaluate three key pillars: the percentage of actual economic damage recovered, the overall socio-economic contribution of the related land project to the local or national economy, and compliance with the prerequisites of the specific policy framework.

The resolution establishes four distinct tiers for penalty reductions:

- Tier 1: Up to 25% damage remediation allows for a maximum reduction of 25% of the penalty. - Tier 2: Between 25% and 50% remediation allows for a maximum reduction of 50% of the penalty. - Tier 3: Between 50% and 75% remediation allows for a maximum reduction of two-thirds of the penalty. - Tier 4: Between 75% and 100% remediation allows for a maximum reduction of four-fifths of the penalty.
