Vietnam accelerates amendments to Land, Housing, and Real Estate laws

The Vietnamese Government is accelerating the amendment of three critical laws: the Land Law, the Housing Law, and the Real Estate Business Law. Under Resolution No. 278/NQ-CP, authorities aim to ensure these laws operate synchronously to reduce project implementation times and compliance costs for businesses.

Key legislative focuses include establishing mechanisms for land price determination, managing land use differences, and preventing corruption in compensation and resettlement. The Land Law 2024 specifically includes provisions to prohibit gender discrimination in land management. Additionally, the Ho Chi Minh City Real Estate Association (HoREA) has proposed expanding the Real Estate Business Law to cover land transfers with existing infrastructure that fall outside traditional project scopes.

In the infrastructure sector, the Ministry of Construction has proposed a new mechanism for highway development. To prevent delays in toll collection and ensure synchronized operation of the North-South Expressway, the Ministry suggests that the State may invest in essential rest stop components—such as access roads, parking lots, and restrooms—before a private investor is selected.
