Yoon Suk Yeol defense seeks acquittal in election law appeal
During the first appellate hearing for former President Yoon Suk Yeol regarding violations of the Public Official Election Act, his legal team argued for an acquittal. The defense cited recent suggestions by Cho Kuk, chairman of the Rebuilding Korea Party's policy research institute, arguing that the current legal definition of ‘falsehood disclosure’ is overly broad and allows for arbitrary punishment.
Yoon was previously sentenced in a first-instance trial to 18 months in prison, suspended for three years, for making false statements during his presidential campaign. The charges involve claims made during debates and interviews regarding his connections to certain individuals. The defense argued that spontaneous, defensive remarks made during campaigns should not be classified as criminal falsehoods.
In contrast, the special prosecutor's team has requested that the court dismiss the appeal and uphold the original sentence. The court has scheduled the examination of witnesses and the defendant for later this month, after which final arguments and sentencing recommendations will be made.
