Zambia State opposes constitutional bail for Mundubile and Zulu

The Zambian State has petitioned the Lusaka High Court to dismiss constitutional bail applications filed by opposition leaders Brian Mundubile, Makebi Zulu, and 16 others. The prosecution argues that the applicants pose a significant flight risk and possess the political influence to interfere with State witnesses if released.

In an affidavit, Senior Superintendent of Police Donald Mulimba stated that the accused face serious charges, including treason and the prohibition of terrorism. The State contends that investigations are complex, requiring the examination of extensive digital forensic evidence, financial records, and cross-border inquiries.

Addressing claims of unreasonable detention, the State argued that a two-month delay is not excessive given the resource constraints of law enforcement and the volume of evidence to be processed. The prosecution also noted that Mundubile and Zulu previously evaded arrest by seeking refuge at the United Nations House, necessitating special arrangements for their transfer into police custody.
