Zambian political treason allegations and court proceedings

Overview

In Zambia, political tensions have escalated following the August 13 general election. All Peoples Congress Party President Nason Msoni called for the Director of Public Prosecutions to investigate allegations of treason involving the UPND and the Tonse Alliance, suggesting that individuals like Makebi Zulu and Brian Mundubile might be used as “sacrificial lambs” in political disputes.

Following these tensions, opposition leaders Brian Mundubile, Makebi Zulu, and 16 others appeared before a three-judge panel at the Lusaka High Court for bail hearings regarding charges of treason and seditious practices. The detainees have been in custody since late August. Defense lawyer Sakwiba Sikota raised concerns regarding their treatment, reporting that the accused were transported from Kabwe to Lusaka without food.

The Zambian State has since petitioned the court to dismiss the constitutional bail applications. The prosecution argues that the applicants pose a significant flight risk and possess enough political influence to interfere with State witnesses. Senior Superintendent of Police Donald Mulimba stated that the accused face serious charges, including treason and the prohibition of terrorism.

Addressing the legality of their prolonged detention, the State contended that a two-month delay is not excessive due to the complexity of investigations involving digital forensics and financial records. The prosecution also noted that Mundubile and Zulu had previously evaded arrest by seeking refuge at the United Nations House.
