While the government has previously issued an injunction requiring the union to maintain at least 75 percent of services due to aviation being classified as an essential service, the union has indicated it may resume industrial action if formal dialogue is not established.

In recent developments, the Ministry of Capital Human formally demanded that ATE guarantee at least 75 percent of services during any industrial action, citing Law No. 25.877. Although the strike was postponed as a gesture of goodwill, ATE has indicated it may resume measures starting Monday, September 7, if negotiations fail. During the previously proposed strike windows, the union had stated it would only guarantee sanitary, humanitarian, organ transplant, and official flights.
