Argentine automotive legal and fraud disputes

Overview

Legal developments regarding the automotive sector in Argentina have involved both large-scale class actions and individual criminal investigations.

In Tierra del Fuego, the Federal Chamber of Comodoro Rivadavia overturned a ruling that had favored approximately 7,000 vehicle buyers. The appellate court rejected a class-action lawsuit against eight automotive companies concerning tax and customs exemptions under Law 19.640, ruling that the statute of limitations had expired since the claims involved transactions from 2001 to 2010.

Separately, authorities are investigating instances of individual fraud. In Chaco, police arrested a suspect after a buyer discovered that a purchased Toyota Hilux had engine and chassis numbers that did not match the documentation. In Lomas de Zamora, a judicial investigation is underway following allegations that a dealership, GL Motors, unauthorizedly used a customer’s vehicle, causing significant damage and mileage.
