Australia domestic gas reservation legislation

Overview

The Australian government has introduced a domestic gas-reservation bill to parliament. The legislation mandates that large liquefied natural gas (LNG) exporters reserve up to 20 per cent of their annual export volumes for domestic use starting in 2028, aiming to lower local heating, power, and manufacturing costs.

The bill stipulates that while existing long-term contracts signed on or before December 22, 2025, are exempt, any contracts renewed, extended, or rolled over after that date must comply with the new rules, “regardless of whether the right to renew or extend the contract existed when the contract was entered into”.

This move has intensified tensions with major Asian energy partners, including Japan and South Korea, as well as potential customers in Malaysia and China. State-backed companies in Japan and South Korea argue that contract extension options are integral to their original investment terms.

Within the industry, energy producers have issued warnings regarding future investment. Executives from companies such as Origin Energy and Woodside have cautioned that the policy could discourage new supply projects. Critics argue that forcing domestic sales during periods of abundance might distort prices and undermine the economic viability of projects that depend on export revenues to offset high development costs. There are further concerns that a poorly implemented scheme could result in high-cost gas being diverted offshore while low-cost production remains in Australia, potentially failing to meet long-term security needs.
