Austria judicial financing reforms

In early July 2026 Austria's Nationalrat approved a suite of measures aimed at modernising the justice system, including an electronic access portal (ESAP), a reform of lawyer pensions, and a new repair‑duty law. These legislative changes were presented as steps to improve efficiency and transparency within the courts.

By the end of the month, the government enacted a further adjustment to the judiciary’s revenue model: on 1 August 2026 standard court fees were raised by 5.7 percent, following a larger 23 percent increase the previous year. The fee hike is triggered automatically when the consumer‑price index exceeds 5 percent, a condition recently met. Justice Minister Anna Sporrer signed the regulation, which can only be suspended by the National Council.

Lawyers responded with strong criticism, arguing that the rising fees limit public access to justice. The president of the Austrian Bar Association warned that Austria is unique in Europe for having a judiciary that generates surplus revenue, which is transferred to the finance ministry while courts suffer staff shortages and budget deficits. The bar association called for a freeze on further fee increases.
