Aviation safety and legal actions in Rio de Janeiro

Overview

Following a series of aviation accidents in Rio de Janeiro, including a mid-air collision in June and a fatal crash in the Tijuca Forest on August 8, Brazilian authorities have implemented significant regulatory and legal measures.

The August 8 crash, which killed pilot Alessandro Rocha and three Colombian tourists from the same family, triggered an explosion and a forest fire that damaged the Atlantic Forest ecosystem within the Tijuca National Park buffer zone. In response, a Federal Court ordered the freezing of assets belonging to Voos Rio Panorâmico e Serviços Aeronáuticos, up to a limit of R$ 10 million. This action follows a request by the Federal Public Ministry (MPF) to secure compensation for collective environmental moral damages and to fund the conservation and restoration of the area.

The court has granted the company and its managing partner 30 days to present a Degraded Area Recovery Plan (PRAD) to restore the site’s ecological conditions. Investigations by the National Civil Aviation Agency (Anac) previously identified serious operational safety management failures, such as maintenance record inconsistencies and crew fatigue issues, resulting in the suspension of the company’s Air Operator Certificate and the grounding of six other aircraft in its fleet.

In response to the broader pattern of incidents, the Brazilian Air Force announced that starting in November, two Special Helicopter Routes—the Boa Vista and Cristo routes—will be canceled. The REH Praia route will also be relocated further from the coastline. Additionally, Anac has increased inspections of panoramic flight operators, having already suspended four of the 12 authorized companies due to irregularities like the falsification of flight reports.
