Overview
Brazil’s electoral justice system is managing various legal disputes and technological threats ahead of the 2026 elections.
In early August, the Superior Electoral Court (TSE) intervened in Rondônia to suspend a decision that had denied former senator Acir Gurgacz eligibility, allowing his Senate candidacy to proceed while an appeal is pending. The provisional ruling, signed by TSE president Minister Kassio Nunes Marques, prevents the local ruling from taking effect during the election calendar but does not constitute a final determination of eligibility.
Additionally, in Paraíba, the Regional Electoral Court (TRE-PB) permitted the release of a DataTrends poll after rejecting a request from the MDB to block its publication. Judge Bianor Arruda Bezerra Neto ruled that the party had not demonstrated “sufficient technical flaws or concrete harm to justify an injunction.”
By mid-August, the focus expanded to include social media regulations and artificial intelligence. In Ceará, the TRE-CE ordered the removal of videos making premature claims about a candidate’s ineligibility. In Paraná, courts are reviewing the eligibility of Deltan Dallagnol for the Senate. Concurrently, the TRE-PB has identified deepfakes as a primary concern, deploying specialized IT teams to combat AI-generated misinformation.
