Brazil bus crash legal actions and damages

In early July 2026 a bus traveling over a bridge in Rio Grande do Sul overturned, killing the driver and injuring seven passengers. The incident added to a series of serious bus accidents across Brazil.

Later that month, Minas Gerais courts dealt with the legal fallout from earlier crashes. A driver from Viação Cometa was indicted for a September 2022 collision on the BR‑040 near Juiz de Fora that claimed four lives, including a toddler, and injured dozens. The Minas Gerais Court of Justice also raised compensation for a victim of a 2007 bus‑tractor‑trailer crash on the BR‑262.

On 30 July 2026, the same BR‑040 driver was formally charged with four counts of involuntary homicide and eight counts of bodily injury, reinforcing criminal accountability for the 2022 accident. In the same set of rulings, a court increased the award for a passenger severely injured in the 2007 BR‑262 bus‑truck collision, adding R$ 50,000, ongoing medical costs and a monthly pension. These developments illustrate a growing judicial emphasis on higher damages and stricter liability for bus‑related fatalities and injuries in Brazil.
