Brazil CNE education regulatory actions
Overview
In early July 2026, Brazil’s National Education Council (CNE) issued a resolution obligating all schools to complete 200 instructional days per year. This rule, responding to a July 2025 recommendation from the Ministério Público Federal (MPF), establishes national parameters for school calendars and crisis-response protocols. It aims to mitigate disruptions caused by armed violence, health emergencies, strikes, and climate events, such as the severe 2024 floods in Rio Grande do Sul. The resolution mandates coordinated action between the Union, states, and municipalities, requiring school-level protocols, clear communication with families, and remedial measures for vulnerable students to prevent the automatic suspension of in-person classes.
Simultaneously, the CNE and the Ministry of Education (MEC) are modernizing higher-education distance-learning regulation. A public consultation, running through August 14, 2026, seeks input on a draft resolution to replace the 2016 framework for graduate and undergraduate distance-learning programmes. Developed by the Higher Education Chamber of the CNE (CES/CNE), the proposal defines standards for presencial, semi-presencial, and fully online formats. Key focus areas include mandatory in-person hours for laboratory practices and extension activities, faculty qualifications, digital infrastructure, student-teacher interaction, and the integration of artificial intelligence.
The consultation, conducted via the Brasil Participativo platform, targets the regulation of hybrid learning, tutoring roles, and the structural requirements for physical support centers to ensure academic standards remain equivalent across all modalities. Following the August 14 deadline, the MEC will undergo a systematization period from August 15 to 22 to analyze proposals and finalize the resolution project.
