Brazilian corporate judicial recovery trends

Overview

Brazil is experiencing a significant increase in judicial recovery filings across various business scales, driven by high interest rates and restricted credit.

Large companies, including Tok&Stok, Habib’s, and Casas Bahia, have entered recovery processes. Data indicates that between mid-2023 and mid-2026, the number of companies in recovery rose by 65.8%. While some entities like the energy company Light have successfully exited judicial recovery through debt-to-equity conversions, historical data shows that only 17.5% of companies entering the process since 2013 have successfully completed it.

Micro and small enterprises (MPEs) are seeing an even sharper surge. As of June 2026, there were 2,821 MPEs under judicial protection, a 41.4% increase compared to June 2025. This growth rate is nearly double that of medium and large companies. Experts suggest small businesses face higher bankruptcy risks due to increased credit costs, declining consumer spending, and a lack of collateral compared to larger corporations.
