Brazilian electoral court rulings on political propaganda

Overview

Brazilian electoral courts have issued rulings against political candidates for exceeding the limits of permissible criticism in digital propaganda.

In one instance, the Superior Electoral Court (TSE) ordered the Workers' Party (PT) to remove a social media video regarding vice-presidential candidate Alfredo Gaspar. Justice André Mendonça ruled that the video’s phrasing suggested a “concrete possibility” of crimes involving the rape of a minor, which constituted accusatory content without sufficient factual support. The court directed X and Meta to make the posts unavailable within 24 hours.

Separately, the Electoral Court of Paraíba ordered the removal of an Instagram video posted by a candidate for federal deputy, Caio, following a challenge by Cabo Gilberto Silva. Judge Renata Barros de Assunção Paiva determined the content used offensive expressions and visual elements associated with physical punishment to suggest the adversary was “deserving of this.” The court noted that such negative electoral propaganda is prohibited under Brazilian law.
