Brazilian judicial rulings on insurance age discrimination
Overview
Legal proceedings in Brazil are addressing the application of age-based discrimination protections within the insurance sector.
The Superior Tribunal de Justiça (STJ) ruled that age-based premium adjustments in group life insurance contracts are legal, provided there is clear contractual provision and compliance with sector-specific regulations. The court rejected the application of the Health Insurance Law and the Statute of the Elderly to these contracts, stating that extending such protections would “compromise the mutualistic balance of the insurance regime.”
Concurrently, the Supreme Federal Court (STF) is reviewing whether the Statute of the Elderly—which prohibits age-based price discrimination in health insurance—applies to contracts signed before the law was enacted in 2004. The case has been referred to the court’s consensus solution center as ministers debate how the rule applies to consumers who reach age 60 after the law’s implementation.
