Brazilian tax rights and immigration for citizens abroad

Overview

Approximately 4.9 million Brazilians reside outside the country, many of whom continue to receive benefits from Brazilian sources. Legal experts note that changing residence does not automatically terminate rights under Brazilian law. For example, Law No. 7.713/1988 provides income tax exemptions for retirees and pensioners diagnosed with serious illnesses, such as cancer, Parkinson’s disease, or multiple sclerosis, to alleviate medical costs.

As migration increases, legal professional Renata Maria Borges notes that modern migration involves managing complex family, professional, and patrimonial ties across multiple borders. Managing Brazilian social security (INSS) and tax obligations is critical. While moving abroad does not automatically cancel INSS retirement benefits, beneficiaries must follow specific procedures, such as life verification and checking for social security agreements between Brazil and their new country of residence.

To manage fiscal status, individuals making a permanent move or staying abroad for more than 12 consecutive months must submit a ‘Declaração de Saída Definitiva do País’ (DSDP) to the Receita Federal. This process officially ends fiscal residency, ensuring income tax applies only to Brazilian-sourced income and helping to avoid double taxation. The communication of departure must be made by the last day of February of the following year, while the DSDP must be submitted by the end of April.

Beyond taxation, immigration requirements vary by destination. In English-speaking countries like Canada, Australia, New Zealand, and the United Kingdom, language proficiency testing is often a prerequisite for skilled work visas or permanent residency.
