Brazil’s child-protection framework continues to expand through the Digital Child Statute (Law 15.211/2025) and the Digital Statute of the Child and Adolescent (ECA Digital), which came into force in March 2026. The ECA Digital mandates protection by design, requiring providers to implement age verification, default privacy settings, parental supervision tools, and restrictions on loot boxes and targeted advertising. Under Decree No. 12.880/2026, new regulations target child and adolescent influencers. Social media platforms that monetize or promote content habitually featuring a minor’s image or routine must obtain prior judicial authorization, as parental consent alone is deemed insufficient when a child’s intimacy sustains commercial activity. This principle was reinforced by the Court of Justice of Santa Catarina (TJSC) following Resolution 687/2026 of the National Council of Justice (CNJ). In a related ruling, the Childhood and Youth Court of Itajaí rejected a request for the continuous commercial exposure of two children on a parent's social media, emphasizing that parental authority does not grant unrestricted rights to use a child's image for economic purposes. Implementation of the ECA Digital has placed age verification at the center of digital protection. While the law requires reliable mechanisms for platforms and games, the National Data Protection Authority (ANPD) is addressing technical privacy risks. To prevent the excessive collection of sensitive biometric or identity data, the ANPD is exploring proportional methods such as self-declaration or age signals from operating ~~systems.~~ systems to separate age verification from full identity disclosure. Legal actions against Discord have intensified following the suicide of a 13-year-old girl in Mato Grosso do Sul. Following a preventive order from the ANPD, Discord suspended real-time video, screen-sharing, and ‘Go Live’ functionalities in Brazil. On August 27, 2026, the Brazilian Attorney General's Office (AGU) filed a lawsuit seeking 500 million reais in damages for collective moral harm. Recently, the ANPD requested explanations from Discord after reports suggested that real-time video features remained available to Brazilian users despite the preventive suspension. The authority warned that failure to comply could result in further actions, including daily fines, and noted the suspension will remain until Discord demonstrates the adoption of adequate safeguards.
