California nightlife drug safety legislation
Overview
California has implemented new legislation requiring licensed bars and nightclubs, specifically those holding Type 48 liquor licenses, to provide drink-spiking prevention lids and drug-testing kits to patrons upon request.
The mandate aims to combat substances such as fentanyl, GHB, and ketamine. Testing tools may include straws, stickers, or test strips, and must be capable of detecting at least one of the three most common substances used in drink spiking: ketamine, Rohypnol, or GHB. Establishments are required to post visible signage regarding the availability of these safety items on both physical premises and websites.
Governor Gavin Newsom signed legislation that removes the expiration date for these requirements. The Alcoholic Beverage Control agency is tasked with conducting periodic inspections to ensure compliance and providing education to staff and management. While venues may charge a nominal fee to cover costs, kits must be offered at low or no cost.
