Chilean government legal challenge to reconstruction reform

The Chilean government has filed a legal challenge with the Constitutional Court regarding Article 31 of a reconstruction reform bill. The contested provision would mandate that utility companies—including electricity, water, and gas providers—provide free service reconnections to residential users and micro, small, and medium-sized enterprises in catastrophe zones, regardless of unpaid debts.

Finance Minister Jorge Quiroz argued the measure was added via parliamentary indication and deviates from the reform’s “idea matriz” (core idea) of financing and accelerating reconstruction. The government contends the provision is unconstitutional, alleging it violates Article 69 of the Constitution by lacking a direct relationship to the bill’s original objectives. This dispute follows devastating fires in Valparaíso, Ñuble, and Bío Bío.

The legal action has highlighted internal coordination issues within the Executive branch. Biminister Claudio Alvarado, of the Interior and the General Secretariat of Government, admitted he was unaware of the legal action. Security Minister José García Ruminot addressed the discrepancy, acknowledging a “difficulty in more formal internal communication” but attributed the lapse to intense workloads rather than intentional withholding of information. Minister Quiroz described the lack of coordination as “incidental,” noting the challenge was a collective decision signed by the President and four ministers.

The Constitutional Court has admitted the challenge, granting the Senate and the Chamber of Deputies five days to submit observations and evidence. If the court rules in favor of the government, utility companies may be permitted to charge for reconnections in emergency zones.
