Chilean legal and judicial controversies regarding sexual犯罪

Overview

Recent legal developments in Chile have highlighted tensions regarding sexual offenses and the protection of minors. In Concepción, the Court of Appeals upheld disciplinary sanctions against a student at Universidad San Sebastián for sexual harassment, ruling that the university fulfilled its legal obligations to maintain a safe environment. Separately, the Court of Appeals of La Serena ordered the removal of online content that accused a minor of a crime, citing protections for a child’s honor and psychological integrity.

Concurrently, the Ministry of Justice has faced significant backlash following the administrative granting of 56 sentence reductions for individuals convicted of sexual abuse and rape against minors. The Defensoría de la Niñez rejected these measures, noting that Law No. 21.421 excludes such offenders from receiving benefits. While Minister of Justice Fernando Rabat stated the reductions followed Supreme Court criteria for cases occurring before the law’s implementation, legislative efforts have been proposed to extend prohibitions to crimes committed prior to the 2022 reform.

Under the administration of President José Antonio Kast, the controversy has intensified. Reports indicate the 56 reductions included 27 individuals convicted of sexual abuse and 29 of rape. Further scrutiny arose after it was revealed the Ministry also signed decrees benefiting inmates at the Punta Peuco detention center, including those convicted of qualified kidnapping and torture. In response, opposition lawmakers have announced plans to interpellate Minister Rabat and are proposing new legislative initiatives to prevent offenders of sexual crimes against minors from accessing such benefits.
