Overview
The Colombian government is developing a new bill of submission targeting members of criminal organizations who choose to cease illegal activities and surrender to authorities. Justice Minister Iván Cancino clarified that this initiative is intended for criminal structures without political recognition, distinguishing it from peace negotiations with armed groups.
The proposed legislation includes provisions for the surrender of weapons, collaboration with authorities, and the handover of illicit assets. It offers legal benefits such as sentence reductions of up to 30% for command-level members and up to 50% for rank-and-file members. However, the government maintains that submission will not halt extradition processes or suspend existing arrest warrants.
In response to these developments, former Justice Minister Ángela María Buitrago has called for the process to be handled through ordinary justice rather than special transitional mechanisms. She emphasized that the surrender of an estimated 19,000 to 23,000 individuals requires individual investigations, a strengthened Prosecutor’s Office, and coordination with the Police to ensure that surrender implies “investigation, accusation, and conviction.”
