Defamation ruling in Florianópolis election
Overview
A court in Santa Catarina ordered Vanderlei Farias, a member of the PT party, to pay R$ 20,000 in moral damages to Fábio Botelho. The ruling stems from election propaganda used during the 2024 mayoral campaign in Florianópolis, which falsely linked Botelho to a corruption scheme known as ‘Operação Mercadores da Morte’.
The 4th Civil Court of the Capital found that the campaign material, which used terms such as ‘mafia’, ‘bribes’, and ‘corruption’, exceeded the limits of political criticism. While the propaganda claimed Botelho’s ‘approval’ was required for the scheme, the court noted that Botelho was merely a witness and not an investigated or indicted party in the criminal action. The compensation amount was determined based on the gravity of the accusations and the content’s wide reach on the internet and television.
