Digital harassment and privacy litigation in South America

Overview

In Paraguay, students at the Universidad Nacional de Asunción (UNA) reported being victims of digital harassment involving the unauthorized distribution of intimate images and AI-manipulated deepfake montages. These images were reportedly circulated via an anonymous website and messaging apps like Telegram and WhatsApp.

In Argentina, the Supreme Court of Justice has addressed similar issues of digital privacy and defamation. Following a habeas data lawsuit by a student from the National University of La Plata (UNLP), the Court ruled against the use of anonymous social media accounts to conduct virtual ‘escraches’ (public shaming campaigns).

The Court overturned a previous dismissal that had cited public interest, ruling that while gender violence is a matter of public concern, it does not justify speech that violates an individual’s privacy or right to defense. The ruling ordered Facebook Argentina S.R.L. to remove defamatory posts and provide identifying information, such as IP addresses and email addresses, to help identify the account holders.
