Dutch regulator fine against Uber over driver deactivations
Overview
The Dutch Data Protection Authority (AP) imposed a fine of approximately €825 million on Uber for violating the European Union’s General Data Protection Regulation (GDPR). The penalty follows an investigation into Uber’s use of automated systems to suspend or deactivate driver accounts between 2018 and 2022.
Regulators determined that Uber’s algorithms made significant decisions regarding drivers’ livelihoods—such as deactivating accounts due to suspected fraud or low ratings—without sufficient human oversight, transparency, or notification. The investigation, prompted by complaints from 171 drivers supported by the human rights organization Ligue des droits de l’Homme, found that drivers were often left without income and lacked a proper way to contest these algorithmic decisions.
The regulator specifically identified a violation of Article 22 of the GDPR, which restricts decisions based solely on automated processing that produce legal or similarly significant effects.
The fine, which represents 4% of Uber’s annual global turnover, is one of the largest GDPR penalties to date. Uber has announced its intention to appeal, arguing that the fine is “disproportionate” and that its policies include mechanisms for human review and challenges to suspensions.
