Ecuador Civil Aviation Law reform

Ecuador is updating its aeronautical regulations through a new Organic Law of Civil Aviation, representing the first major reform in over 20 years.

Initial legislative stages focused on establishing a regulatory framework for unmanned aerial vehicles (drones). The proposal sought to mandate registration for drones exceeding 250 grams via the General Directorate of Civil Aviation (DGAC) and established penalties for interference with emergency services, such as forest firefighting.

Following the legislative process, the National Assembly approved the law, which expands beyond drone regulation to modernize the broader aviation sector. The approved legislation introduces new management requirements for municipal airports in Quito, Guayaquil, and Cuenca, requiring concurrent management agreements with the Central Government. It also permits the delegation of airport services to private entities through public tenders.

Furthermore, the law deregulates the domestic market by removing previous requirements for international airlines to be domiciled in Ecuador or maintain 100% Ecuadorian staff. It also establishes new mandates for passenger compensation regarding flight delays or cancellations.

The National Assembly passed the measure with 88 votes in favor and 60 against. The law unifies previous aeronautical codes to implement an ‘open skies’ policy designed to increase connectivity, routes, and frequencies. Key provisions include a 50% discount on airfares for senior citizens over 65 and persons with disabilities for both domestic and international flights.

The reform shifts aeronautical policy leadership to the relevant ministry, while the DGAC retains technical authority. While supporters argue the law will boost tourism and employment, opposition members raised concerns regarding national sovereignty and the potential loss of control over strategic infrastructure.
