El Salvador MS-13 crackdown and judicial response

Overview

Law enforcement operations in El Salvador have targeted members of the MS-13 gang, beginning with the capture of specific gunmen in Sensuntepeque and Apopa. These individuals were identified as being linked to various MS-13 cliques and faced warrants for crimes including aggravated homicide and illegal firearm possession.

Following these arrests, the judicial system has escalated sentencing, with the Fourth Organized Crime Court issuing life sentences to members for involvement in a terrorist organization. This includes additional sentences ranging from 30 to 45 years for numerous gang members across multiple cliques.

The intensified crackdown has coincided with a growing prison crisis and human rights concerns. Reports indicate that over 93,000 people have been incarcerated, and the organization Socorro Jurídico Humanitario has documented 575 deaths in state custody without convictions. Detainees have reportedly suffered from severe health issues, such as irreversible kidney failure. In response to the mass incarceration, President Nayib Bukele is considering the conditional release of approximately 50% of prisoners charged with “menor responsabilidad” (lesser responsibility).
