EU New Genomic Techniques regulatory framework

The European Union is implementing a new regulatory framework for plants derived from New Genomic Techniques (NGT). The regulation, established under Regulation 2026/1388, introduces a two-tier system to distinguish between different types of genetic modifications.

Category NGT-1 includes plants with minor modifications considered equivalent to those obtained through conventional breeding. Once verified, these varieties will follow regulatory frameworks similar to conventional crops. Category NGT-2 covers more complex modifications, which will remain subject to existing GMO legislation.

As the regulation moves toward full application in July 2028, the European Commission has conducted public consultations to clarify how operators demonstrate NGT status and to establish equivalence criteria. In Spain, the Ministry of Agriculture, Fisheries and Food has begun analyzing the framework, with industry groups welcoming the tools as a means to develop crops resilient to climate change. Officials have called for coordination between administrations, the scientific community, and the agricultural sector to prepare necessary administrative procedures during the transition period.
