EU whistleblower and transparency law implementation
Overview
European nations are transposing EU directives into domestic law to strengthen whistleblower protections and workplace transparency.
In Portugal, Law no. 93/2021 requires entities with 50 or more employees to establish secure reporting channels and provide feedback on investigations within three months. Spain has introduced Law 2/2023 to provide a unified national approach for all public sector entities and private organizations with more than 50 employees to combat corruption.
Italy has expanded its regulatory framework through Legislative Decree No. 24, which mandates whistleblowing systems for many medium and large private companies to prevent retaliation and ensure GDPR compliance. Furthermore, Italy is implementing rules regarding pay transparency following EU Directive 2023/970. These measures require employers to include salary ranges in job advertisements, prohibit inquiries into candidates' previous pay history, and allow employees to request information on average pay levels broken down by gender.
