The European Union is reforming air passenger rights and standardizing airline fees through Regulation 2026/2202. Published on October 2, 2026, the regulation entered into force on October 22, 2026, with full applicability beginning October 23, 2027. These rules apply to all flights departing from the EU, including those operated by non-EU airlines, and to flights arriving in the EU operated by European carriers. During the legislative process, the European Parliament successfully opposed efforts by transport ministers to weaken protections. The Parliament voted to maintain the three-hour delay threshold for compensation, with reimbursement amounts between €250 and €600 depending on distance. Specifically, compensation is set at €250 for flights up to 1,500 km, €400 for intra-EU flights over 1,500 km, and €600 for longer routes. Passengers arriving more than five hours late are entitled to request a full refund. In cases of prolonged delays, airlines must provide enhanced assistance, including meals, refreshments, internet access, and hotel accommodations if an overnight stay is required. A landmark ruling by the Court of Justice of the European Union (Case C-108/26) has further bolstered these rights, stating that airlines can no longer automatically avoid compensation by citing air traffic control decisions. Carriers must now prove such decisions were caused by truly extraordinary circumstances rather than routine operational management. To facilitate claims, the Parliament proposed standardized, pre-filled forms in all official EU languages. Regarding baggage, airlines must include two pieces of cabin baggage in the base ticket price: one small personal item (maximum 40 × 30 × 15 cm) and one trolley (up to 55 × 40 × 20 cm). To ensure transparency, airlines and booking portals must display airfares inclusive of this luggage from the start of the booking process. Notably, for flight cancellations, passengers are entitled to a full refund that includes any service or booking fees paid to travel agencies or online platforms. Additional protections include family seating for children under 14, provisions for persons with disabilities, and free corrections for material errors. Enforcement will be managed by national authorities, who will receive increased powers to monitor compliance and initiate inspections.
