FIFA global transfer regulation reforms

FIFA has approved a new regulatory framework for the global football transfer system, scheduled to take effect on January 1, 2027. The reforms specifically target Article 17 of the Regulations on the Status and Transfer of Players, which governs the consequences of unilateral contract terminations without just cause.

The changes follow legal challenges, such as the Lassana Diarra case, where the Court of Justice of the European Union ruled that certain existing regulations were contrary to European law by impeding the free movement of players.

Developed through negotiations with stakeholders including FIFPRO, UEFA, and CONMEBOL, the new rules aim to balance club contractual stability with player labor rights. The framework seeks to ensure that compensation for breaking a contract is “reasonable and proportional to actual agreement data” rather than being set at amounts that effectively prevent player movement. The reforms intend to make the calculation of costs more objective and predictable, distinguishing between pre-agreed release clauses and compensation awarded after a unilateral breach.
