Financial crime and fraud investigations in Poland
Overview
Polish authorities are pursuing multiple legal actions involving large-scale financial irregularities and fraud.
In the judicial sector, significant developments have occurred regarding corporate and institutional misconduct. In Gdańsk, a court overturned a dismissal in a case against three former executives of the State Forests (Lasy Państwowe) management in Pomerania, who face charges of exceeding authority and failing to fulfill duties between 2021 and 2024. Concurrently, in Warsaw, prosecutors have indicted board and supervisory members of GetBack S.A. for allegedly manipulating the company’s financial structure to benefit an external entity, causing damages exceeding 1.3 billion PLN. Authorities have secured assets including real estate and art valued at approximately 4 million PLN.
In the environmental sector, law enforcement is investigating over 1,000 cases of fraud within the ‘Clean Air’ (Czyste Powietrze) subsidy program. Minister of Climate and Environment Paulina Hennig-Kloska reported that fraudulent activities, such as inflating costs and using falsified documents, may have defrauded approximately 8,000 families. The estimated amount of unliquidated or overdue advances is 285 million PLN. To mitigate the impact, the Ministry has drafted legislation to allow for the suspension of liabilities for affected individuals and to enable funds to pursue claims directly from fraudsters.
