Italian Parliament Rejects Delmastro‑Caroccia Chat Seizure

Overview

In July 2026 the Chamber’s Giunta per le Autorizzazioni refused the Rome prosecutor’s request to release instant‑messenger chats between former justice under‑secretary Andrea Delmastro and restaurateur Mauro Caroccia, citing procedural concerns. The centre‑right majority later blocked the seizure request, and on 4 August a secret ballot rejected the prosecutor’s demand by 206‑133. The vote was defended by majority relator Pietro Pittalis, a Forza Italia MP, who argued that the decision upholds parliamentary privilege under article 68 of the Constitution.

Opposition deputies, including members of the Five Star Movement, the Greens‑Left and the Democratic Party, displayed smartphones with the slogan “Fuori le chat” and some blindfolded themselves, accusing the government of shielding party allies. The heated scene led to a temporary suspension of the session. Leaders such as Elly Schlein and Giuseppe Conte warned of political fragmentation and potential constitutional challenges.

On 5 August the Chamber reaffirmed the rejection with the same 206‑133 vote, confirming the earlier decision. On 6 August Justice Minister Carlo Nordio publicly celebrated the outcome, arguing that a blanket seizure of Delmastro’s phone would breach privacy rights, parliamentary immunity and constitutional guarantees of inviolable correspondence. Nordio asserted confidence that Delmastro has no mafia ties and stressed the need to balance anti‑mafia investigations with protection of personal data.
