Overview

The German Federal Ministry of Transport (BMV) maintains a tiered system for penalties related to traffic violations. Drivers of various vehicles, including cars, trucks, motorcycles, and bicycles, face fines and points recorded in the Flensburg driving register.

The penalty structure consists of three stages based on accumulated points. Between four and five points, drivers receive a formal reprimand and may attend a driving aptitude seminar. Reaching six or seven points triggers a warning that further violations will lead to license revocation. At eight or more points, the mandatory withdrawal of the driving license occurs.

Beyond the point-based system, German law provides for more severe legal consequences. Under Section 69 of the German Criminal Code (StGB), courts possess the authority to revoke driving privileges permanently if an individual is deemed unfit to operate a motor vehicle due to the nature of a criminal offense. While most traffic violations result in temporary bans, a permanent revocation is applied when a court determines a person poses a continuous risk to public safety. In such cases involving a lifetime ban, the individual is legally barred from ever obtaining a driver's license again. For other temporary bans, individuals must typically prove their fitness to drive, often through a Medical-Psychological Assessment (MPU), once the blocking period expires.
