German social security and welfare regulations
Overview
Recent administrative and legal developments in Germany have clarified various aspects of social welfare and pension benefits.
Regarding pension insurance, the Deutsche Rentenversicherung (DRV) maintains specific guidelines for widow and widower benefits. Eligibility typically requires a marriage or registered partnership of at least one year. Benefits are categorized into a ‘small widow’s pension’, limited to two years for survivors under age 47 who are capable of working and not raising children, and a ‘large widow’s pension’, which is indefinite. For partners born before January 2, 1962, an ‘old law’ provides a higher percentage of the deceased’s pension. During the first three months following death, known as the ‘death quarter’, the pension is paid in full before the survivor's own income is factored into the calculation.
In the realm of housing assistance, the Landessozialgericht Nordrhein-Westfalen rejected a request for a Jobcenter to cover significant rent arrears, ruling that such payments were unnecessary once applicants had secured new residences. Regarding Wohngeld (housing allowance), regulations specify that prepaid rent does not disqualify recipients, as authorities must account for these payments when calculating eligibility. For those on fixed-term employment contracts, benefits are generally limited to the duration of said contracts.
As of July 1, 2026, Germany transitioned from the Bürgergeld system to a new social welfare framework called Grundsicherungsgeld under the Second Social Code (SGB II). This reform introduces stricter cooperation requirements and increased sanctions. Asset protections have also been restructured into age-based thresholds, ranging from 5,000 euros for those under 20 to 15,000 euros for those over 51.
