German social security fraud investigations
Overview
Authorities in Germany have taken legal action against companies for violating social insurance laws through illegal employment practices.
In Regensburg, a security firm was fined after investigations by the Finanzkontrolle Schwarzarbeit uncovered 57 instances where employees were not registered for social insurance between late 2022 and late 2023. This resulted in a loss of over €31,000 to the insurance system, which was subsequently repaid. Two officials were sentenced to fines by the Landgericht Regensburg.
In a larger case, the German Federal Court of Justice upheld convictions against a criminal gang that operated an electrical installation company. Between 2016 and 2021, the group employed over 1,300 Serbian workers on construction sites without paying required social security contributions, instead using false registrations with Serbian service companies. The scheme caused an estimated loss of approximately 18.7 million euros, leading to prison sentences for the primary defendants.
