The crash occurred on March 24, 2015, when the co-pilot intentionally steered the Airbus A320, a Lufthansa subsidiary aircraft flying from Barcelona to Düsseldorf, into a mountain massif. The victims included a group of students and teachers from Haltern am See who were returning from an exchange program in Spain.

A legal contradiction persists regarding liability. While a higher court previously ruled that Lufthansa was not liable because pilot medical supervision is a state responsibility, the current court has issued a preliminary assessment suggesting the claim against the state might be ‘unsubstantiated’ as long as victims can seek compensation from Lufthansa. Attorney Professor Julius Reiter has criticized this tension, arguing that victims should not be caught in a loop of shifting responsibility between the airline and the state. This ongoing trial continues to focus on institutional responsibility and whether state oversight met legal requirements.
