More than eleven years after the 2015 Germanwings Flight 4U9525 crash in the French Alps, a civil lawsuit involving thirty relatives and survivors of the 150 victims has commenced at the Braunschweig District Court. The plaintiffs are seeking damages from the German federal government, with individual claims ranging from 500 to 110,000 euros. The legal proceedings center on whether state authorities, specifically the Federal Aviation Office (LBA), failed in their duty to monitor co-pilot Andreas Lubitz’s medical and psychological fitness. Plaintiffs argue that medical assessments regarding potential psychiatric illnesses were inadequate and that legal requirements for monitoring flight readiness were not properly implemented by authorities. The crash occurred on March 24, 2015, when the co-pilot intentionally steered the Airbus A320, a Lufthansa subsidiary aircraft flying from Barcelona to Düsseldorf, into a mountain massif. The victims included a group of students and teachers from Haltern am See who were returning from an exchange program in Spain. A legal contradiction persists regarding liability. While a higher court previously ruled that Lufthansa was not liable because pilot medical supervision is a state responsibility, the current court has issued a preliminary assessment suggesting the claim against the state might be ‘unsubstantiated’ as long as victims can seek compensation from Lufthansa. Attorney Professor Julius Reiter has criticized this tension, arguing that victims should not be caught in a loop of shifting responsibility between the airline and the state. This ongoing trial continues to focus on institutional responsibility and whether state oversight met legal requirements.
