Greek urban planning and construction legislation

Overview

The Greek Ministry of Environment and Energy has introduced legislative proposals to reform urban planning and the ‘Nikolaos Tagaras’ Spatial Planning and Building Code. The measures, which are open for public consultation until October 24, aim to address illegal constructions, property mergers, and the regulation of small-scale building works.

One component of the proposal seeks to expand exceptions for ‘Category 5’ illegalities, which involve the most severe violations such as buildings without permits. These exceptions may cover public interest structures like schools and social welfare facilities. The legislation also includes provisions to accelerate the licensing of Hellenic Defense Systems facilities to facilitate their relocation and allow for the transfer of dams to EYDAP to support water management.

Additionally, the ministry is proposing new rules for small-scale construction works. Under these changes, certain tasks—such as installing autonomous heating systems or placing prefabricated homes for refugees—would only require simple approval rather than a full building permit. However, some works, such as sheds (stegastra), will remain subject to specific financial limits.
