The oral trial against musician Cristian ‘Pity’ Álvarez continues in Buenos Aires, overseen by the Tribunal Oral en lo Criminal y Correccional N° 29. Álvarez faces charges regarding the 2018 shooting death of Cristian Maximiliano ‘Gringo’ Díaz in the Villa Lugano neighborhood. It is alleged that Álvarez shot Díaz four times with a .25 caliber pistol following a dispute in the Samoré housing complex. During the initial hearings, the tribunal rejected defense requests to suspend proceedings based on Álvarez’s physical or mental state, noting that medical reports confirmed his cognitive capacity. Álvarez declined to testify during the first session, stating he would provide his version ‘later,’ while sharing details of his health, including hypertension, diabetes, and a history of drug addiction. Witness testimony has included the victim’s former partner, Verónica Román, and Álvarez's former partner, Agustina Inbernoz, who testified via Zoom. Inbernoz noted that Díaz had confronted the musician and stated she had previously discarded the firearm in a sewer. Friend of the victim, Carlos Ulises Stiempcich, testified that a verbal dispute escalated when Díaz made a gesture to headbutt the musician, prompting Álvarez to fire. Stiempcich claimed the first shot struck Díaz near the eye, with three additional shots fired after the victim fell. Recently, defense attorneys Javier Baños and Sebastián Queijeiro have requested a trial by popular jury, arguing for jurisdiction under City of Buenos Aires laws. They have also renewed arguments regarding Álvarez’s mental capacity, citing a forensic report of ‘severe, potentially irreversible psycho-organic deterioration’ and requesting a suspension for further neurological and psychiatric evaluations. The tribunal has since rejected these requests to suspend the proceedings or move the case to a jury trial. During recent hearings, Álvarez reportedly fell asleep, which prompted judicial warnings regarding his conduct.
