Stiempcich claimed the first shot struck Díaz near the eye, with three additional shots fired after the victim fell.

Recently, defense attorneys Javier Baños and Sebastián Queijeiro have requested a trial by popular jury, arguing for jurisdiction under City of Buenos Aires laws. They have also renewed arguments regarding Álvarez’s mental capacity, citing a forensic report of ‘severe, potentially irreversible psycho-organic deterioration’ and requesting a suspension for further neurological and psychiatric evaluations. The tribunal has since rejected these requests to suspend the proceedings or move the case to a jury trial. During recent hearings, Álvarez reportedly fell asleep, which prompted judicial warnings regarding his conduct.
