Hong Kong financial regulatory oversight expansion
Overview
Hong Kong regulators have intensified their oversight of the financial sector, moving from increased scrutiny of traditional investment banking to expanded supervision of digital assets.
In mid-September, the Securities and Futures Commission (SFC) signaled a crackdown on investment banks and IPO processes. During industry meetings, enforcement officials instructed firms to prepare for regulatory raids by ensuring immediate access to employee emails, computer systems, and private search areas. This follows approximately eight raids on brokerages or funds in 2026, driven by concerns that high deal volumes might cause sponsors to neglect their “gatekeeping responsibilities.”
By late September, regulatory efforts expanded to include the cryptocurrency sector. Through a new Memorandum of Understanding between the SFC and the Accounting and Financial Reporting Council (AFRC), oversight now extends to licensed virtual asset service providers (VASPs), licensed corporations, authorized funds, and registered open-ended fund companies.
The agreement covers financial and compliance reporting, as well as the audit and assurance work performed by respective auditors. This framework mandates meticulous third-party assurance for client-asset custody logs, proof-of-reserves, and corporate balance sheets. The cooperation includes real-time information sharing, case referrals, mutual assistance, and coordinated on-site inspections intended to identify emerging risks and prevent exchange failures.
